These Terms govern your use of escapefieldops.com and the Escape application. Escape by Elevate is a product of Elevate Academy, LLC ("Escape," "we," "us"). By creating an account, signing in, or using the service, you agree to them.
1. The service
Escape is a subscription platform for service businesses — scheduling and dispatch, estimates, invoicing and payments, review generation, membership programs, and the automations that connect them. What you receive depends on the plan and any add-ons stated in your Service Order or proposal, which is incorporated into these Terms.
2. Accounts and access
You are responsible for the accuracy of your account information, for every user you invite, and for all activity under your credentials. Do not share logins. Tell us immediately at support@escapefieldops.com if you suspect unauthorised access. We may suspend access to protect the platform or another client.
3. Fees and payment
- Subscription fees are billed in advance on the cycle stated in your Service Order and are charged automatically to your payment method on each due date.
- The Personalized Build fee is due at signing, covers configuration and launch, and is non-refundable once implementation begins.
- Usage is billed separately. Your plan covers the system, not consumption. Text messages, emails, call minutes, phone numbers, and AI minutes bill on use from an auto-recharging balance at the rates published on our plan page. Usage is not included in any plan.
- Add-ons may require third-party subscriptions in your own name. Where that is the case it is stated before purchase, and those costs are yours and are not included in Escape fees.
- Late or failed payment may result in suspension after notice. You remain responsible for fees accrued before suspension.
- Fees are exclusive of taxes, which you are responsible for where applicable.
4. Term, changes and cancellation
Subscriptions renew automatically for successive periods until cancelled. Either party may cancel effective at the end of the current billing period by written notice. Fees already paid are not refunded on cancellation, and the Personalized Build fee is never refundable once implementation has begun. We may change pricing on renewal with at least 30 days' written notice.
5. Your data
Your data is yours. You retain all rights to the business and customer information you put into Escape. You grant us the limited licence needed to host, process, back up, and display it in order to run the service for you. On termination we make your data available for export for a limited period, after which it is deleted.
You are responsible for having the legal right to collect and process the customer information you load into Escape, including consent for any messaging you send through it.
6. Messaging, consent and compliance
Escape sends messages on your behalf. You are the sender. You are responsible for complying with all applicable laws and carrier rules, including the TCPA and carrier registration requirements. You agree to obtain and keep records of consent before messaging anyone, to honour opt-outs immediately, and never to use Escape to send unlawful, deceptive, or unsolicited bulk messages. Carrier registration outcomes and timing are controlled by carriers, not by us. We may suspend messaging that puts the platform or other clients at risk.
7. Acceptable use
Do not reverse engineer, resell, sublicense, or white-label the platform; attempt to access another client's data; probe or interfere with the service's security; upload malware; or use Escape to violate the law or infringe anyone's rights.
8. Intellectual property
The Escape platform, its configurations, templates, automation designs, documentation, and branding remain our property. Your subscription is a licence to use it, not a transfer of ownership. Feedback you give us may be used to improve the product without obligation to you.
9. Third-party services
Escape depends on third-party infrastructure and communications providers. Their availability and terms are outside our control, and we are not liable for their failures, changes, or discontinuation. Where an add-on requires a third-party account in your name, that relationship is between you and that provider.
10. Availability and support
We aim for continuous availability but do not guarantee uninterrupted service. Planned maintenance is scheduled outside business hours where practical. Support is provided during published business hours by email and scheduled call.
11. Disclaimers
Except as expressly stated, the service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will meet your requirements, produce any particular business result, or be error-free.
12. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunity. Our total aggregate liability arising out of or relating to these Terms will not exceed the amounts you paid us in the twelve months preceding the claim.
13. Indemnity
You will indemnify and hold us harmless from claims arising out of your data, your messaging, your use of the service, or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state or federal courts located in South Carolina, and both parties consent to that jurisdiction.
15. Changes to these Terms
We may update these Terms. Material changes will be communicated to active clients by email and take effect on renewal or 30 days after notice, whichever is later. Continued use after that constitutes acceptance.
